Appeals Committee
Purpose
The PAOC Appeals Committee is convened when necessary, usually when a student-athlete desiring to transfer to another institution for the purpose of participating in a sport at that institution has been denied permission by KSU to contact or accept contact by another institution and wishes to appeal that decision.
Procedure
In such cases, a committee of three KSU faculty and/or staff members, none of whom are employed by the Athletics Department, shall be formed to hear the appeal of the student-athlete. In order to initiate such an appeal, the aggrieved student-athlete (complainant) must submit his or her appeal in writing to the chair of the committee within 15 business days from the date of receiving the letter denying contact permission. The complainant must be informed by KSU student email by a representative of the Athletic Department of the right to submit a written appeal, the deadline for submitting the appeal, and to whom the appeal is to be submitted and the contact information for that person.
The committee chair and the alternate chairs are ex officio positions, tied to the official position, not to the individual who may hold the position at any one time. The alternate chairs will serve when the chair is not available. The positions are:
- Chair - Director, Dept. of Student Conduct and Academic Integrity
- 1st Alternate - Faculty Athletics Representative
- 2nd Alternate - Registrar
The chair of the committee shall call a meeting of the committee as soon as is practicable, and, in any event, soon enough to complete the entire appeals process within 15 business days from the date the complainant’s written appeal is received by the chair. The complainant must be offered the opportunity to participate in the hearing either in person, by telephone, or by other feasible electronic means. The coach who denied permission must also be offered the opportunity to participate in the hearing either through a written statement or in person, by telephone, or by other feasible electronic means. The committee will proceed with due haste to examine the merits of the complaint and to render a decision in writing to the complainant within 15 business days from the date the complainant’s written appeal is received by the chair. During the proceedings, the student-athlete may present any and all evidence that he or she deems necessary to support the appeal, except that the committee must agree that the evidence is in some way relevant. Such evidence may consist of documentation and/or testimony, within reason, as determined by the chair of the committee.
Both complainant and respondent may be accompanied by an advisor; the role of advisor must, however, be restricted to advice. Complainant and respondent must make his or her own case before the committee.
If the committee by a majority vote overturns the denial, permission to contact (along with the release) shall be granted to the particular institution(s) about which the student-athlete was appealing the denial of permission to contact. If the committee denies the appeal, permission to contact the particular institution(s) or for use of the one-time transfer exception will be withheld, and the appeals process required per NCAA Bylaws 13.1.1.3.1 and 14.5.5.2.10 is complete.
The decision of the committee is final and there are no further appeals regarding the decision.
